Abstract

The purpose of this article is to analyze concretely the importance of the Judiciary in the creation of Law in a Constitutional State. Therefore, in addition to the theoretical approach we will not leave aside a concrete analysis of what actually takes place in the Brazilian legal system. We will argue that the creation of norms by the judiciary is inherent to the rule of law, facing concretely these challenges.
